Litigation & Alternative Dispute Resolution

Keane & Beane maintains an active and sophisticated litigation practice covering a wide range of areas including:

  • Labor and employment
  • Commercial transactions
  • Environmental matters
  • Real property
  • Shareholder derivative disputes
  • Business disputes
  • Construction claims

Our strategy starts with a thorough evaluation of potential options to identify the most advantageous and cost-effective solution for our clients. In our experience, litigation is not always the best path forward; thus we are trained and experienced in mediation and other forms of dispute resolution.

When matters cannot be adequately resolved without recourse to the courts, we advocate zealously on behalf of our clients. We routinely appear in New York State trial courts, including the Commercial Divisions of Westchester and New York Counties, and have argued numerous appeals in the Appellate Divisions of New York. Our attorneys have argued appeals in the New York Court of Appeals involving issues of statewide importance. We have an equal breadth of experience in U.S. District Courts and the Second Circuit Court of Appeals.

The size and strength of our Municipal Law practice greatly enhances our firm’s ability to effectively handle litigation over land use determinations made by municipal boards and agencies. Because our clients in such matters have included both real estate developers and municipalities, we know the land use review process and laws from both sides of the table.

We have represented the owners of shopping centers, golf courses, corporate office parks, residential subdivisions and mixed-use developments, and have handled litigation involving:

  • Claims under the New York State Environmental Quality Review Act (SEQRA) and the Religious Land Use and Institutionalized Persons Act (RLUIPA)
  • A $440 million resort and casino in upstate New York
  • Redevelopment of the former General Motors assembly plant in Sleepy Hollow
  • A $91 million correctional center in Ulster County.

In the area of commercial transactions and business disputes, we have represented companies large and small, including entrepreneurs, joint ventures, limited liability companies and other business entities. We are adept at defending business owners and companies against employment discrimination claims and class action suits, which can present unique challenges for small and mid-sized companies.

Important Advantages for Clients

In addition to our skill and experience, we believe each of our clients deserves responsive service. Thus, we pride ourselves on providing thoughtful personalized attention while delivering a level of litigation sophistication associated with large New York City firms.
