Keane & Beane, P.C. Successfully Defends Suit By Police Officer Seeking GML Section 207-c Benefits

On January 26, 2016, the Honorable Susan Cacace, Acting Justice of the Supreme Court, Westchester County, issued a Decision denying an Article 78 Petition brought by a City of Peekskill Police Officer against the City seeking benefits under General Municipal Law Section 207-c. Keane & Beane, P.C., on behalf of the City, argued that the Chief of Police had correctly denied the Police Officer’s claim for Section 207-c benefits because the Officer failed to follow the collectively bargained procedures for submitting a claim for Section 207-c benefits. The Decision confirms that police officers are required to comply with all procedural requirements when claiming GML Section 207-c benefits in order to protect the municipalities from potentially frivolous claims. Lance H. Klein and Eric L. Gordon were lead counsel on behalf of the City.
