Last evening the Trump administration determined to withdraw the federal guidelines relating to transgender students in public schools. In doing so, the federal government spokesperson indicated that it is the position of the current administration that how transgender students are accommodated is a state’s rights issue.
The New York State Education Department issued guidance on transgender students prior to even the Obama administration’s guidelines and SED’s guidance has not been impacted by today’s decision out of Washington. Accordingly, our office will continue to advise clients to provide accommodations consistent with the SED guidance document.
