Keane & Beane maintains an active and sophisticated litigation practice that covers a wide range of areas including labor and employment, commercial transactions, environmental matters, real property, shareholder derivative disputes, business disputes and construction claims.
Our approach to such matters invariably starts with a thorough evaluation of potential options to identify the most advantageous and cost-effective solution for our clients. The best path forward does not always require litigation, so our litigators are trained and experienced in mediation and other forms of alternative dispute resolution.
Of course, some matters cannot be adequately resolved without recourse to our courts. In such cases, we formulate a strategy to advocate zealously on behalf of our clients. We routinely appear in New York State trial courts, including the Commercial Divisions of Westchester and New York Counties, and have argued numerous appeals in the Appellate Divisions of New York. Our attorneys have argued appeals in the New York Court of Appeals involving issues of statewide importance. We have an equal breadth of experience in U.S. District Courts and the Second Circuit Court of Appeals.
The size and strength of our Municipal Law practice greatly enhances our firm’s ability to effectively handle litigation over land use determinations made by municipal boards and agencies. Because our clients in such matters have included both real estate developers and municipalities, we know the land use review process and applicable laws from both sides of the table.
In the area of land use litigation, we have significant experience handling cases involving claims under the New York State Environmental Quality Review Act (SEQRA) and the Religious Land Use and Institutionalized Persons Act (RLUIPA). We have experience with litigation over large projects, such as a $440 million resort and casino in upstate New York, the redevelopment of the former General Motors assembly plant in Sleepy Hollow, and a $91 million correctional center in Ulster County. We have represented the owners of shopping centers, golf courses, corporate office parks, residential subdivisions and mixed-use developments.
In the area of commercial transactions and business disputes, we have represented entrepreneurs, joint ventures, limited liability companies and other business entities in a wide range of matters. We routinely defend business owners and companies against employment discrimination claims, as well as cases brought under the Fair Labor Standards Act (FLSA) and New York Labor Law, including class action suits. Such cases can present unique challenges for small and mid-sized companies, and we are adept at handling such matters.
